1. Introduction

This Online Purchase & Refund Policy ("Policy") governs transactions, payments, and refunds related to services provided by Maximos Real Estate ("we," "us," or "our") through the website realestatebelek.com (the "Website").

This policy applies to all users who engage our services or make payments through the Website. By making a purchase or payment through this Website, you acknowledge that you have read, understood, and agree to be bound by this Policy.

If you do not agree with this Policy, you must not proceed with any purchase or payment.

2. Scope of Services

2.1 Real Estate Agency Services

Maximos Real Estate provides real estate agency services, including but not limited to:

  • Property listing and marketing services
  • Property consultation and advisory services
  • Transaction facilitation services
  • Documentation coordination services
  • Property viewing arrangements

2.2 Service Fees

Service fees, commission structures, and payment terms are established through separate service agreements or contracts.

All fees and payment obligations will be clearly disclosed before services are provided.

2.3 Online Completion of the Buying Process

In many cases, the property buying process can be coordinated and substantially completed online, without your physical presence in Turkey, subject to applicable Turkish law and the requirements of the competent authorities.

Where legally permitted and agreed in writing, a power of attorney may be issued remotely in your favor or in favor of a representative, and this power of attorney may be used to support related procedures, including bank account opening and completion of purchase formalities.

Title deed transfers (TAPU) are always finalized at the official Land Registry (deed office) in Turkey and, where a power of attorney is used, the transfer is executed by the authorized representative acting on your behalf in accordance with the granted authority.

3. Payment Terms

3.1 Payment Methods

We accept payments through methods specified in individual service agreements, which may include:

  • Bank transfers to designated company accounts
  • Cash payments made in person against official receipt vouchers
  • Crypto currency payments limited to Bitcoin (BTC) or Tether (USDT), where permitted by applicable law and agreed in writing
  • Credit or debit card payments (where applicable)
  • Other payment methods as agreed upon in writing

3.2 Payment Obligations

Payment obligations are determined by the specific service agreement or contract entered into between you and Maximos Real Estate.

Payment terms, due dates, and amounts will be specified in writing before services commence.

3.3 Currency

Payments may be accepted in Turkish Lira (TRY), Euro (EUR), US Dollars (USD), or other currencies as specified in the service agreement.

Currency exchange rates and any associated fees are the responsibility of the payer unless otherwise specified.

4. Third-Party Payments

4.1 Government Fees and Taxes

Property transactions involve various government fees and taxes that are separate from our service fees, including but not limited to:

  • Title deed transfer tax (4% of declared property value)
  • Land Registry registration fees
  • Property taxes
  • Translation and notarization fees
  • Utility connection fees

These fees are paid directly to government authorities and are not refundable by Maximos Real Estate. Government fees are subject to Turkish law and regulations.

4.2 Third-Party Service Provider Fees

Property transactions may require services from independent third parties, including:

  • Independent Lawyers: Legal fees for independent legal representation are paid directly to the lawyer and are subject to separate agreements.
  • Notaries: Notary fees are paid directly to notaries and are non-refundable once services are rendered.
  • Banks: Banking fees, mortgage fees, and financial service charges are paid to financial institutions and are subject to their own policies.
  • Valuation Companies: Property valuation fees are paid to licensed valuation companies.

We are not responsible for refunds of fees paid to third-party service providers. Refund policies for third-party services are governed by the agreements you enter into with those providers.

5. Refund Policy

5.1 General Refund Principles

Refund eligibility is determined on a case-by-case basis and depends on:

  • The specific service agreement or contract terms
  • The stage of service completion
  • The reason for the refund request
  • Whether services have been rendered

5.2 Non-Refundable Fees

The following fees are generally non-refundable:

  • Fees for services that have been fully rendered
  • Government fees and taxes paid to Turkish authorities
  • Third-party service provider fees (lawyers, notaries, banks, valuation companies)
  • Administrative fees for processing completed transactions
  • Fees for services cancelled due to client breach of contract

5.3 Refund Eligibility

Refunds may be considered in the following circumstances:

  • Services not rendered due to our failure to perform
  • Duplicate payments made in error
  • Overpayments beyond the agreed service fee
  • Services cancelled by mutual agreement before substantial work has commenced

Refund requests must be submitted in writing and will be evaluated based on the specific circumstances and service agreement terms.

5.4 Refund Processing

If a refund is approved:

  • Refunds will be processed within 30 business days of approval
  • Refunds will be issued in the same currency and method as the original payment, where possible
  • Currency exchange rate differences may apply
  • Processing fees may be deducted from refund amounts

6. Property Purchase Transactions

6.1 Property Purchase Payments

Payments made for property purchases (deposits, down payments, purchase prices) are transactions between buyers and sellers.

Maximos Real Estate acts as an intermediary and is not a party to property purchase agreements. Refunds of property purchase payments are governed by the sales contract between the buyer and seller, not by this Policy.

6.2 Transaction Cancellation

If a property transaction is cancelled:

  • Our service fees are subject to the terms of our service agreement
  • Property purchase payments are subject to the sales contract terms
  • Government fees paid are non-refundable
  • Third-party service fees are subject to those providers' policies

6.3 Prepayments and Refundability

As a general principle, prepayments and purchase payments made for ready properties, where the title deed transfer (TAPU) has not yet taken place, are refundable at one hundred percent (100%) of the paid amount, provided that the refund request is made before the title deed transfer is completed and subject to applicable Turkish legal rules.

For properties under construction where no title deed transfer has yet occurred, refundability depends on the timeline of the purchase and the stage of completion at the time of the refund request.

By way of example, where a construction period continues for approximately one year, up to twenty percent (20%) of the agreed property purchase price may be retained as a contractual deduction in accordance with Turkish legal rules and market practice.

The exact refund conditions, applicable percentages, timelines, and any contractual deductions will be defined and agreed in the written purchase agreement (buying contract), in which all financial obligations and refund terms are fully declared.

7. Service Cancellation

7.1 Cancellation by Client

If you cancel services before they are rendered, refund eligibility depends on:

  • The terms of the service agreement
  • Whether preparatory work has been completed
  • Whether third-party services have been engaged
  • The reason for cancellation

7.2 Cancellation by Maximos Real Estate

We reserve the right to cancel services in cases of:

  • Client breach of contract
  • Non-payment of fees
  • Illegal or fraudulent activity
  • Circumstances beyond our reasonable control

Refund eligibility in such cases will be determined based on services rendered and the specific circumstances.

9. Limitation of Liability

Our liability for refunds is limited to the amount of fees paid directly to Maximos Real Estate for services we have agreed to provide.

We are not liable for:

  • Refunds of government fees or taxes
  • Refunds of third-party service provider fees
  • Property purchase payment refunds (governed by sales contracts)
  • Indirect or consequential damages

10. Changes to This Policy

We reserve the right to modify this Policy at any time. Material changes will be indicated by updating the "Last Updated" date.

Changes will apply to new transactions and service agreements entered into after the effective date of the changes.

12. Governing Law

This Policy is governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes arising from or relating to this Policy shall be subject to the exclusive jurisdiction of the courts of Turkey.
